Book of Specific Terms (Technical, Financial, and Legal)
For Sweeping and Transporting Solid Waste in the Eastern Sector District
[1997]
Article I. Definitions:
- Administration: Chairmanship of Aleppo City Council.
- Contractor: Person or persons, natural or legal, who have presented bids and
been accepted by the Administration as successful.
- Subject of Contract: Sweeping and cleaning the streets, pavements and
squares in the area specified on the attached plans; collection of the resulting
solid waste; emptying and washing the waste containers as well as cleaning the
area round them; and transporting the solid waste in vehicles to the dump
specified by the Administration, giving particular attention to the rain
drainage points to ensure their remaining open.
- District of Contract: The area wherein the work is required and which is
specified on the attached plans. The main streets bounding the District are part
of it.
Article II. Terms Governing the Execution of Contract
A.
- The Contractor shall undertake to execute the subject of Contract in the
District of Contract, so that cleanliness is always achieved at a good level
acceptable to the Administration according to the programme agreed upon. Two
districts can be assigned to one contractor if the Administration deems it
appropriate.
- The Contractor shall coordinate with the Administration about the method,
timing, and technique of executing this contract, emptying the solid waste
containers, to ensure continued cleanliness. This shall be done according to a
written programme prepared by the Administration for this purpose and given to
the Contractor. The Administration shall be entitled to compel the Contractor in
emergencies to work outside official office hours and outside his contracted
districts provided that such work would be counted in the monthly accounts.
- It shall be the Contractor's responsibility to get the workers needed to
execute his Contract, and he shall undertake to secure their requirements and
entitlements together with all that is needed to perform his work well in the
eyes of the Administra, according to the attached table which contains the
number of workers and vehicles and which is considered an integral part of the
Book of Terms.
- The Contractor shall not employ any of the Administration's current workers
and if he does, an amount of ten thousand Syrian pounds shall be deducted for
each worker.
- Work shall begin before 7 AM, and containers must be continuously empty of
solid waste. The Contractor shall undertake to move solid waste to the place
designated by the Administration.
- The Contractor shall guarantee the safety of the compactors put at his
disposal by the Administration, undertake to get them repaired during the period
of the Contract, and return them in a good technical condition at the end,
similar to their condition when he collected to him. This shall be done on a
delivery-receipt form.
B. The Administration's Obligations
- The Administration shall undertake to mark off dump sites outside the city.
- The Administration shall appoint patrols selected from its personnel. These
shall have the same official character as the judicial police, and their duties
shall include: ensuring that citizens comply with cleanliness rules and adhere
to the publicly proclaimed times of putting their solid waste outside their
homes; and reporting any violation thereof. The Contractor or his representative
can accompany these patrols provided that he provides the necessary vehicle for
transporting the solid waste which has been illegally disposed of.
- The Contractor shall undertake to provide the following compactors:

- The Administration shall undertake to hire out to the Contractor the
following compactors without drivers if he is unable to get compactors from
another source.

The hiring method and conditions shall be specified in an attached book of
terms which shall be an integral part of this Contract.
- An amount of 5% of the monthly accounts shall be withheld as a surety in
order to make certain that the Contractor shall pay what might be due to the
Administration. The amount shall be returned with the performance bond when the
contract period ends. The warranty period shall be limited to one month because
the project is a cleanliness project.
- If the Contractor does not provide cleanliness service in the contracted
district on a particular day, the Administration shall do the work and deduct
double its value. If he fails to do what he has undertaken or if he violates the
terms stated in this book, the Administration shall execute the work at his
expense and impose the appropriate deduction which the Director of Health
Affairs decides. A 10% deduction or more shall be considered as a legally
delivered warning to him even without using the proper procedures.
- The Fine for Delay
The fine for each day of delay shall be 0.01% of the
total value of the Contract unless this delay has occurred because of the
Administration or of another reason. The fine shall not exceed 20% of the total
value of the Contract.
- If the Contractor does not provide the required number of workers and
vehicles per shift, according to the Contract, the following amounts shall be
deducted from the monthly account:
- SP200 for every worker lacking.
- SP500 for every three-wheeled cycle lacking.
- SP1,500 for not bringing a compactor to the contracted District
- SP2,000 for not bringing the fork-lift tracked vehicle to the District.
- SP1,500 for not bringing the tipper-truck to the District.
- SP100 for emptying a container by the Administration.
A supervision and work acceptance group shall be appointed by the City
Council Chair on the basis of a nomination by the Director of Health Affairs.
The Follow-up Office, the Supervision Group and the special inspection group for
the contracted districts shall be directly responsible for the work of the
Contractor and for the preparing of the monthly accounts before the Director of
Health Affairs or the one his deputy.
Article III. Period and Effectiveness of the Contract
The period of the contract shall be 12 months, starting a day after the
Contractor has been informed of the commencement order which follows official
validation of the contract
Article IV.
The bidder shall undertake to pay a bid bond of SP950,000 to be increased to 10%
of the value of the Contract within thirty days starting either on the day after
that of informing the contractor of the decision of the bid committee that his
bid has been successful , or the day of commencement, whichever the earlier,
under penalty of confiscating the bid bond and offering the project to be
executed at his expense. The incompleteness of the bond shall not prevent the
continuation of the procedures to get the Contract officially validated The
Administration shall have the right to confiscate the bond and offer the project
to be executed at the expense of the candidate-contractor if he does not sign
the contract on the following day of his being informed that he has been the
successful bidder.
Article V.
The bidder must submit the probative papers stated in Article 12 of the
regulation of administrative sector contracts issued in Presidential Decree No.
228 (1969).
Article VI
Execution Sanctions
A. In cases of neglect by the Contractor or his failure to execute the Contract,
the Administration shall directly execute the work at his expense in a suitable
way. a
B. If the Contractor stops from continuing the execution of the work, the
Administration shall execute it at his expense. If he stops for three
consecutive or seven separate days, the Administration shall execute it at his
expense right to the end without giving him a warning, using contracting by
mutual consent, with no announcement.
C. Any warning or any Administration's measure equal to a warning shall justify
taking the work from the Contractor and executing it using a contract by mutual
consent without any announcement.
Article VII. Contract Assignment and Sub-contracts
The Contractor shall have no right to assign any work or part thereof, nor shall
he have the right to sub-contract the work or part thereof to other persons
without the written consent of the Administration. Getting this consent,
however, shall not in any way force the Administration to enter into any
relation of any kind with sub-contractors, nor shall it release the Contractor
from his technical, administrative, and legal obligations and responsibility to
the Administration, according to the provisions of this Contract.
Article VIII.
The Contractor shall pay all the expenses, taxes and fees of this Contract,
including advertising costs even if they were numerous, together with the
contract stamps on two copies.

Contract:
